Raymond Knutsen was also the defendant in a separate civil case brought by his former wife and veterinary business partner, Nancy Kotsull. The dispute arose after Kotsull left their jointly owned veterinary practice and invoked the buyout provisions of the company’s Operating Agreement.
The Vermont Superior Court found that Knutsen refused to cooperate with the required appraisal process, failed to pay Kotsull for her ownership interest, and failed to pay her share of the rent generated by the jointly owned clinic property.
The court also found that, on the eve of the originally scheduled trial, Knutsen reported Kotsull to the Rutland Police Department for alleged embezzlement. According to the ruling, Knutsen knew the same financial issues were already the subject of the civil case and told the police officer that he hoped a criminal investigation would cause Kotsull to drop her lawsuit.
The judge found that the police report was an intentional act aimed at avoiding Knutsen’s contractual obligations and that he went to the police solely to pressure Kotsull to abandon the case. The court described his conduct as malicious and without a legitimate purpose.
On August 31, 2017, the court awarded Kotsull $208,872.95. That amount included $94,010 for breach of contract, $100,000 in unpaid rent, nominal damages for breach of the covenant of good faith and fair dealing, and $20,000 in punitive damages, offset by $5,138.05 awarded to Knutsen on one limited counterclaim.
Knutsen appealed. In June 2018, the Vermont Supreme Court affirmed the judgment in full. The Supreme Court upheld the finding that the police report was made maliciously, with no legitimate purpose, and was intended to pressure Kotsull into dropping her case.
